Welcome to bmiatravel.com, the website of Bohemia LLC, doing business as B.Mia Travel ("B.Mia Travel," "we," "us," or "our"). These Site Terms of Use ("Terms") apply to everyone who visits or uses this website, including any member area, forms, or content we provide here (together, the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site shares information about B.Mia Travel, a members-only host agency for destination wedding travel advisors, including our membership, training, events, and the destinations we work with. Information on the Site is for general purposes only. It is not an offer of membership, and applying does not guarantee acceptance. Any membership relationship is governed by a separate written agreement between you and B.Mia Travel.
2. Applications and Accounts
If you apply for membership, join a waitlist, or create an account, you agree to give information that is accurate, current, and complete, and to update it if it changes. If you apply on behalf of a business, you confirm that you are authorized to act for that business. You can ask us to update or correct your information at any time by emailing hello@bmiatravel.com.
3. Your Login Details
If you are given login details for any part of the Site, keep them private and do not share them with anyone. You are responsible for activity that takes place under your login. Let us know right away at hello@bmiatravel.com if you believe your login has been used without your permission.
4. Our Content
The text, photographs, graphics, icons, logos, training materials, and other content on the Site are owned by B.Mia Travel or used with permission, and are protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, sell, or create derivative works from any Site content without our prior written permission.
5. Trademarks
"B.Mia Travel," "B.Mia Travel Collective," our logos, and our palm and star marks are trademarks of B.Mia Travel. Names and logos of resorts, suppliers, and other third parties belong to their respective owners. Nothing on the Site gives you a right to use any of these marks without written permission from the owner.
6. Acceptable Use
When using the Site, you agree not to:
break any law or regulation, or encourage anyone else to do so;
post or send anything that is false, misleading, defamatory, harassing, or offensive;
upload viruses or harmful code, or try to interfere with how the Site works;
try to gain access to areas, accounts, or systems you are not authorized to use;
collect information about other users or members without their consent; or
use the Site to send unsolicited advertising or spam.
We may investigate suspected misuse and may suspend or block access to the Site for anyone who breaks these Terms.
7. Third-Party Links
The Site may link to resorts, suppliers, and other third-party websites. We do not control those sites and are not responsible for their content, products, services, or privacy practices. Visiting them is at your own risk.
8. Confidential Information
Members and applicants may receive non-public information from us, such as commission details, supplier terms, or training materials. You agree to keep that information confidential, to use it only for your relationship with B.Mia Travel, and to return or delete it if we ask or if that relationship ends.
9. Disclaimer
The Site and its content are provided "as is" and "as available." We work to keep information accurate and up to date, but we do not promise that the Site will be error-free, uninterrupted, or free of harmful components, or that any information (including destination, supplier, pricing, or earnings information) is complete or current. Any examples of commission or income are illustrations only and are not a guarantee of results.
10. Limitation of Liability
To the fullest extent allowed by law, B.Mia Travel and its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising from your use of, or inability to use, the Site, even if we have been told such damages are possible.
11. Indemnification
You agree to defend and hold harmless B.Mia Travel and its owners, team members, and partners from any claims, losses, or expenses (including reasonable attorneys' fees) that result from your breach of these Terms or your misuse of the Site.
12. Privacy and Cookies
When you submit a form on the Site, we collect the information you provide (such as your name, email, phone number, and business details) and use it to respond to you, review applications, and send updates you have asked for. We do not sell your personal information. The Site, which is hosted by Squarespace, uses cookies and similar technologies to keep it running, understand how it is used, and improve it. You can control cookies through your browser settings; disabling them may affect how parts of the Site work.
13. Changes to the Site and These Terms
We may update, change, or remove any part of the Site at any time. We may also update these Terms from time to time; the "Last updated" date above shows when they last changed. Your continued use of the Site after an update means you accept the revised Terms.
14. General
You may not transfer your rights or obligations under these Terms to anyone else without our written consent. If any part of these Terms is found unenforceable, the rest will remain in full effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.
